The framework
One proceeding, two stages.
Concurso mercantil (art. 1)
A single proceeding before a federal juez de distrito.
Etapa de conciliación (art. 2)
The debtor stays in possession while the conciliador brokers a convenio; maximum 185 days, never beyond 365.
Etapa de quiebra (arts. 167, 178)
The síndico replaces the debtor and liquidates.
Concurso con plan de reestructura previo (arts. 339–342)
A pre-pack filed with creditors holding 40% or more of the debt.
The role
What the conciliador and the síndico have to do.
- 01
The specialists are appointed by IFECOM through a random draw ordered by the judge: the visitador (art. 29), the conciliador (art. 43) and the síndico (art. 169).
- 02
Qualification requires at least five years of relevant experience, no public-sector employment, and passing IFECOM's selection process (art. 326), plus a bond in every case (art. 327).
- 03
The conciliador files the lista provisional de créditos within 30 days of publication, in IFECOM's own format (art. 121), then the lista definitiva within a non-extendable 10 days (art. 130) — miss it and the judge asks IFECOM to appoint a replacement.

The judge then grades and ranks the claims across five statutory classes (arts. 132, 217).
- 05
The síndico delivers the inventory and opinion within 60 days (art. 190) and sells, by default, at public auction (art. 198).
- 06
Both file a report to the judge every two months (art. 59).
The formats are prescribed. The tabulation behind them is still manual.

Why now, specifically
IFECOM supervision, in five days.
Since 10 May 2025, IFECOM's supervision guidelines require every specialist to upload each court filing to a central platform within five business days, with random audits cross-checked against the judiciary's own case system.
The reporting burden is now continuous and machine-checked, on formats IFECOM prescribes.
